The Nine will take up an appeal from the state of Michigan once more, two months after dismissing the first appeal. According to the Tribune : Michigan Attorney General Mike Cox appealed that high court’s decision, arguing that the U.S. Army Corps of Engineers had withheld the information that DNA from Asian carp had been detected in Lake Michigan days before the court issued its ruling. Cox said the new DNA findings raised the level of urgency for the court to step in to force Illinois to close shipping locks in the Chicago River and Cal-Sag Channel. A decision may not be announced until Monday. Illinois Attorney General Lisa Madigan said the new DNA findings were actually known before the court’s decision and shouldn’t affect the original decision. Michigan has been joined by the other Great Lakes states – Minnesota, Wisconsin, Indiana, Ohio, Pennsylvania and New York – as well as the Canadian province of Ontario in their fight to have the shipping locks closed to prevent the spread of the carp.
